Terms of Service

1. Introduction

These Terms of Service govern your use of ItsWhisky, a business management platform for home bakers and sweet makers, operated by Kaiah Digital Solutions in Barbados. By creating an account or using the platform, you agree to these terms.

2. Your Account

You are responsible for maintaining the security of your account and for all activity that occurs under it. You must provide accurate information when registering and keep it up to date. You must be at least 18 years old to use ItsWhisky.

3. Subscriptions and Payment

ItsWhisky is offered on a subscription basis across three tiers: Knead, Rise, and Glaze. Subscription fees are billed in advance, either monthly or annually, depending on the billing cycle you select. Payments are processed securely through our third-party payment processor. ItsWhisky does not store your full card details.

4. Cancellation

You may cancel your subscription at any time from within your account settings. Cancellation takes effect at the end of your current billing period. You will retain access to the platform until that date.

5. Annual Billing

ItsWhisky offers both monthly and annual subscription billing. Subscribers who select annual billing are charged the full annual amount at the start of each billing cycle. Annual billing amounts are:

• Knead plan: USD $143.90 per year
• Rise plan: USD $268.70 per year
• Glaze plan: USD $479.90 per year

Annual subscriptions are non-refundable. No prorated refunds are issued for early cancellation. Subscribers on annual plans retain full access to the platform until the end of their paid annual period, at which point the subscription must be renewed to maintain access.

Founding Member subscribers on annual billing are subject to their confirmed discounted rate as communicated at the time of signup. Cancellation of a Founding Member subscription permanently forfeits the discounted rate and the Founding Member status. Reinstatement at the founding rate is not available after cancellation.

ItsWhisky reserves the right to adjust subscription pricing with 30 days written notice to active subscribers. Price changes do not apply to the current billing period already paid.

6. Refund Policy

Full details of our refund and cancellation terms are set out in our Refund Policy, which forms part of these Terms of Service.

7. Acceptable Use

You agree not to misuse the platform, attempt unauthorised access to other accounts or systems, or use ItsWhisky for any unlawful purpose. We reserve the right to suspend or terminate accounts that violate these terms.

8. Intellectual Property

The ItsWhisky platform, including its design, branding, and underlying technology, is the property of Kaiah Digital Solutions. Content you upload (such as recipes, images, and client information) remains yours. You grant us a limited licence to store and display it as needed to operate the platform.

9. Limitation of Liability

ItsWhisky is provided on an "as is" basis. To the fullest extent permitted by law, Kaiah Digital Solutions is not liable for indirect, incidental, or consequential damages arising from your use of the platform.

10. Governing Law

These Terms are governed by the laws of Barbados. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts of Barbados.
