Terms of Service

1. The Service

ItsWhisky is a subscription-based business management platform built for Caribbean home bakers and sweet makers. It provides tools for managing orders, invoices, recipes, inventory, clients, finances, and a public baker profile. We may add, change, or remove features over time to improve the Service.

2. Accounts & Eligibility

You must be at least 18 years old and able to enter into a binding agreement to use the Service. You are responsible for keeping your login details secure and for all activity under your account. Please notify us immediately if you believe your account has been accessed without your permission.

3. Subscriptions & Free Trial

ItsWhisky is offered on three subscription tiers — Knead, Rise, and Glaze — each available on a monthly or annual billing cycle. New accounts may include a free trial period. Current pricing is shown on our pricing page and is billed in the currency assigned to your island. Your subscription renews automatically at the end of each billing period unless you cancel before the renewal date.

4. Payments & Card Processing

All card payments are processed securely by PowerTranz, our payment gateway. We do not see or store your full card numbers. By subscribing, you authorise us (through PowerTranz) to charge your chosen payment method for the recurring subscription fee until you cancel. If a payment fails, we may retry it and may suspend access until payment is successful.

5. Delivery of Service

ItsWhisky is a digital software service. There are no physical products and nothing is shipped. Access to your subscribed tier is granted automatically and immediately upon successful payment, and is delivered entirely online through your web-based dashboard, accessible from any device with an internet connection.

6. Export Restrictions

ItsWhisky is a digital service with no physical goods, and no export restrictions apply to its use.

7. Cancellations & Refunds

You can cancel your subscription at any time from your account settings. Cancellation stops future renewals; you keep access until the end of your current paid period. Refunds are handled in line with our Refund Policy. In summary: monthly plans are not refunded for partial periods, annual plans are not refunded on a prorated basis, genuine billing errors are fully refunded within five to seven business days, and Founding Member benefits are permanently forfeited once a subscription is cancelled.

8. Acceptable Use

You agree not to:

• Use the Service for any unlawful, fraudulent, or harmful purpose.
• Upload content that is illegal, infringing, or that you do not have the right to use.
• Attempt to access other users’ accounts or data, or to disrupt the Service.
• Resell or redistribute the Service without our written permission.

9. Your Content

You retain ownership of the content you create on ItsWhisky — your recipes, client records, invoices, and business information. You grant us a limited licence to store and process this content only as needed to provide the Service to you. We will never sell your business data.

10. Intellectual Property

The ItsWhisky name, logo, design, and software are owned by Kaiah Digital Solutions and are protected by applicable law. These Terms do not grant you any right to use our brand or software except as needed to use the Service.

11. Disclaimers & Limitation of Liability

The Service is provided “as is”. While we work hard to keep it reliable, we do not guarantee it will always be uninterrupted or error-free. Any financial summaries or reports produced by the platform are for your reference only and are not professional accounting or tax advice. To the fullest extent permitted by law, KDS is not liable for indirect or consequential losses arising from your use of the Service.

12. Changes to These Terms

We may update these Terms from time to time. If we make a material change, we will notify registered users by email. Continuing to use the Service after an update means you accept the revised Terms.

13. Governing Law

These Terms are governed by the laws of Barbados. Any disputes will be handled in the courts of Barbados.
